A Professional Conduct Investigator for the Department of State created a test character on the platform, searched for "psychiatry," and selected Emilie, which the site describes as "Doctor of psychiatry. You are her patient." The investigator then told the chatbot about feeling "sad, empty, tired all the time, and unmotivated." Emilie responded with a discussion of depression, asked whether the user wanted to book an assessment, and, according to the lawsuit, claimed to hold a Pennsylvania medical license.
"We will not allow companies to deploy AI tools that mislead people into believing they are receiving advice from a licensed medical professional," Shapiro said in a statement. The governor’s office added that the state intends to enforce existing medical‑practice statutes to protect consumers from deceptive AI‑driven health advice.
When approached for comment, a spokesperson for Character.AI declined to discuss the lawsuit but reiterated the company’s policy that user‑created characters are fictional and intended for entertainment or role‑playing.
