The amendment also seeks the removal of OpenAI CEO Sam Altman from the nonprofit’s board if the court rules in Musk’s favor. Musk argues that OpenAI’s shift to a capped‑profit model turned the lab into a de facto subsidiary of Microsoft, violating donor agreements and defrauding the founding group.
